Grounds That Win a GST Appeal: Limitation, Jurisdiction & More

Most GST appeals are not won on the tax arithmetic – they are won on the grounds for a GST appeal: the legal and procedural defects in how the demand was raised. A strong, well-pleaded set of grounds can set aside a demand regardless of the amount. Here are the grounds that most often decide a GST appeal.

1. Limitation
A demand issued beyond the statutory time limit is unsustainable. Check the period involved against the limit under Section 73, 74 or the new 74A – a time-barred order is one of the cleanest grounds for a GST appeal. See our guide on Section 73 vs Section 74.
2. Jurisdiction
An order passed by an officer without proper jurisdiction, or beyond the scope of the show cause notice, is defective. A demand cannot travel beyond the allegations and grounds set out in the notice.
3. Breach of natural justice
If no proper opportunity of hearing was given, if a personal hearing was denied, or if the order does not deal with the taxpayer’s submissions, the principles of natural justice are breached – a frequently successful ground for a GST appeal.
4. Wrong invocation of the fraud provision
Where Section 74 (or the fraud limb of 74A) is invoked without specifically alleging and establishing fraud, wilful misstatement or suppression, the demand can be challenged on that ground alone – fraud cannot be assumed.
5. Burden of proof and documentary gaps
The burden of proving the alleged evasion lies on the department. Demands built on assumptions, third-party data not confronted to the taxpayer, or missing documents are vulnerable. A non-speaking order that fails to give reasons is similarly weak.
Plead the grounds early
The grounds for a GST appeal should be identified at the reply stage, not invented later – the first reply shapes the whole matter through first appeal and the GSTAT appeal. Keep the record clean, raise every available defect, and support each ground with the relevant provision and evidence.

Frequently asked questions
What are the strongest grounds for a GST appeal?
Limitation, lack of jurisdiction, breach of natural justice, wrong invocation of the fraud provision, and the department failing to discharge its burden of proof.
When should grounds be raised?
At the reply stage. The first reply shapes the matter through first appeal and GSTAT, so every available defect should be raised early.
Can a GST demand be set aside on procedure alone?
Yes. A time-barred order, a jurisdictional defect, or a breach of natural justice can set aside a demand regardless of the tax amount.
