GST Litigation and Appeals in Hyderabad

Received a GST notice, demand order or registration cancellation? Our team of advocates and chartered accountants handles the full chain: notice reply, personal hearing, first appeal, appeal before the GST Appellate Tribunal (GSTAT) and writ remedies in the High Court where the law allows.

Who needs this

  • Businesses that received a show cause notice, demand order or recovery notice.
  • Taxpayers facing registration cancellation, refund rejection or input tax credit denial.
  • Companies planning an appeal against an adjudication order.

What we do

  • Study the notice and the department allegations before the reply is drafted.
  • Draft the reply with legal grounds, documents and evidence, and appear at the hearing.
  • Check limitation, jurisdiction, natural justice and procedural defects in the notice.
  • File the first appeal and prepare the pre-deposit working.
  • File and argue the appeal before the Appellate Tribunal.
  • Advise on the writ route before the Telangana High Court in fit cases.

Documents and details we usually need

  • Notice or order with all annexures.
  • Returns, books and reconciliations for the period.
  • Earlier replies, correspondence and portal screenshots.
  • Invoices, contracts and proof of supply or credit.

Legal framework

  • Demand provisions: Sections 73, 74 and, for later periods, 74A of the CGST Act, 2017.
  • First appeal to the Appellate Authority under Section 107, generally within three months of the order, with a pre-deposit.
  • Appeal to the Appellate Tribunal under Section 112, with a further pre-deposit.
  • Writ jurisdiction under Article 226 of the Constitution, subject to the alternate remedy principle.
  • Time limits can be extended only within the limits the Act allows, so act early.

Frequently asked questions

How much time do I have to reply to a GST notice?

The notice states the date. Never wait for the last day. Share it with us as soon as you receive it so we can review and, if needed, request time.

Is a pre-deposit required to appeal?

Yes. The Act requires payment of the admitted amount and a percentage of the disputed tax for the first appeal and a higher percentage for the Tribunal, subject to the caps in the Act. We work out the exact figures for your order.

Should I file a writ or an appeal?

It depends on the facts. Courts generally expect the statutory appeal route unless there is a jurisdictional or natural justice defect. We assess both options for you.
