GST First Appeal vs GSTAT Appeal: Choosing the Right Forum

GST notice reply in Hyderabad — ASMT-10, DRC-01A and DRC-01 explained by ComplianceKart

When a GST order goes against you, the GST first appeal vs GSTAT appeal question decides where you go and when. They are two different rungs of the same ladder – the first appeal before the Appellate Authority, and the second appeal before the GST Appellate Tribunal (GSTAT). This guide explains each, the time limits and pre-deposits, and how to choose your next step.

GST first appeal vs GSTAT appeal - choosing the right forum, ComplianceKart Hyderabad

The first appeal under Section 107

The first appeal lies to the Appellate Authority (typically the Commissioner Appeals) under Section 107. It must be filed within three months from the date the order is communicated, with a further month condonable on sufficient cause. To file, you make a pre-deposit of 10% of the disputed tax, subject to the statutory ceiling. This is the first chance to have the order reviewed on facts and law.

The second appeal to GSTAT under Section 112

If the first appeal does not resolve the matter, the next step is the GST Appellate Tribunal under Section 112. The appeal is filed within three months of the first-appeal order, with an additional 10% pre-deposit over and above the 10% already paid – subject to the statutory ceiling. With GSTAT now operational, this forum is finally available, and for backlog matters there is a transitional filing window. See our detailed guide on GSTAT appeals and the deadline.

GST first appeal vs GSTAT appeal: how to choose

You do not choose between them freely – the first appeal comes first, and GSTAT is the remedy against the first-appeal order. The real decisions are whether to appeal at all (weigh the pre-deposit and merits), and how to build the grounds. Now that the Tribunal is functional, the proper remedy against a first-appeal order is a GSTAT appeal rather than a writ to the High Court, which courts increasingly expect you to avoid where the statutory forum exists.

Build the grounds, not just the form

At both levels, the appeal succeeds or fails on its grounds – limitation, jurisdiction, breaches of natural justice, wrong invocation of Section 74, and gaps in the department’s evidence. A strong first appeal often settles a matter; a weak one simply postpones the problem to GSTAT at extra cost.

Frequently asked questions

What is the time limit for a GST first appeal?

Three months from the date the order is communicated, with a further month condonable on sufficient cause, under Section 107.

What pre-deposit applies at each stage?

10% of the disputed tax for the first appeal, and an additional 10% for the GSTAT appeal, each subject to the statutory ceiling.

Can I go straight to GSTAT or the High Court?

No – the first appeal comes first, and GSTAT is the remedy against the first-appeal order. With GSTAT functional, a writ is generally not the right route where the statutory appeal exists.
