“The HUF also gets ₹12 lakh tax-free, right?” It is the most common question we hear after the 2025 slab changes. The answer is no — and knowing why decides whether an HUF is worth it for your family.
The short answer: an HUF gets its own slab rates — nil up to ₹4 lakh under the new regime — but it does not get the ₹60,000 rebate that makes income up to ₹12 lakh tax-free. That rebate is only for resident individuals. The HUF’s advantage is a fresh set of low slabs, not a second ₹12 lakh exemption.
HUF slab rates for Tax Year 2026-27
| New regime (default) | Rate | Old regime | Rate |
|---|---|---|---|
| Up to ₹4,00,000 | Nil | Up to ₹2,50,000 | Nil |
| ₹4–8 lakh | 5% | ₹2.5–5 lakh | 5% |
| ₹8–12 lakh | 10% | ₹5–10 lakh | 20% |
| ₹12–16 lakh | 15% | Above ₹10 lakh | 30% |
| ₹16–20 lakh | 20% | Old regime allows deductions such as Section 80C and 80D | |
| ₹20–24 lakh | 25% | ||
| Above ₹24 lakh | 30% | ||
The real saving: worked example
Assume an ancestral house genuinely owned by the HUF yields ₹6 lakh of taxable rent (after the 30% standard deduction on rental income). The Karta separately has ₹20 lakh of taxable salary.
| Scenario | Tax on the ₹6 lakh (incl. cess) |
|---|---|
| Taxed in the Karta’s hands (on top of ₹20 lakh, new regime) | ₹1,66,400 |
| Taxed in the HUF, new regime | ₹10,400 |
| Taxed in the HUF, old regime, no deductions | ₹33,800 |
| Taxed in the HUF, old regime, with ₹1.5 lakh under Section 80C | ₹10,400 |
Here the family saves about ₹1.56 lakh a year — not because of a rebate, but because the income starts at the bottom of a separate slab ladder.
Deductions an HUF can use (old regime only)
- Section 80C: life insurance premium on any member’s life, ELSS investments and certain other eligible payments, up to ₹1.5 lakh. (An HUF cannot open a new PPF account.)
- Section 80D: health insurance premium for members of the family.
- Under the new regime, these deductions are not available — compare both regimes every year.
Where HUF benefits do not apply
- Your salary always stays your income. It cannot be routed through an HUF.
- Income from your own property that you put into the HUF is clubbed back to you (Part 4).
- Money paid out of HUF income to a member is exempt in the member’s hands — so take care to tax it once, in the HUF.
