HUF Registration in Hyderabad, Step by Step: Deed, PAN, Bank Account and Documents

How to form an HUF: deed of declaration, HUF PAN, bank account, document checklist and common mistakes. HUF Series Part 2 by ComplianceKart, Hyderabad.

HUF Series: Part 1 – What is an HUF · Part 2 – Forming an HUF · Part 3 – Tax benefits · Part 4 – Gifts & clubbing · Part 5 – Partition & closure

There is no “HUF registration” certificate issued by any government office. What people call registering an HUF is really three practical steps: documenting it, getting it a PAN, and opening its bank account. Done properly, it takes days. Done carelessly, it creates problems that surface years later in a scrutiny notice.

The short answer: prepare a declaration (deed) of the HUF, apply for a PAN in the HUF’s name with the Karta’s details, open a bank account in the HUF’s name, and then bring in genuine HUF assets.

Step-by-step: forming an HUF

  1. Decide the name and Karta. The convention is “[Karta’s name] HUF”, e.g. “Ravi Kumar HUF”. The Karta is ordinarily the senior-most coparcener.
  2. Prepare a deed of declaration. Not mandatory under the Income-tax Act, but strongly recommended. It records the Karta, coparceners, members and the corpus with which the HUF starts. Execute it on stamp paper as per state stamp law, signed by the Karta and adult coparceners (confirm the applicable stamp duty in Telangana before executing).
  3. Apply for PAN. Apply online as a “Hindu Undivided Family” using the Karta’s identity and address proof and the HUF declaration. The HUF gets its own PAN, separate from the Karta’s.
  4. Open a bank account in the HUF’s name. Banks typically ask for the HUF PAN, the deed/declaration, KYC of the Karta and a list of coparceners.
  5. Bring in the corpus — carefully. The first money into the HUF decides whether the plan works. Ancestral property, inheritance and gifts from proper sources are the clean routes. Transferring your own income is not (see Part 4).

Document checklist

Document Purpose
Deed of declaration of HUF Evidence of constitution, Karta and members
Karta’s PAN, Aadhaar and photograph PAN application and bank KYC
List of coparceners and members with dates of birth Deed and bank records
Address proof PAN and bank account
Gift deed / will / succession documents Proof of the source of the HUF’s corpus

Mistakes we see most often

  • Starting the HUF with the Karta’s own savings. Income from it gets clubbed back with the Karta — the HUF then saves nothing.
  • Mixing accounts. HUF rent landing in the Karta’s personal account weakens the HUF’s case that the income belongs to it.
  • No paper trail for gifts. Every rupee entering the HUF should have a gift deed or document showing its source.
  • Forgetting to file. Once the HUF has income above the exemption limit, it must file its own return. It cannot use ITR-1.
