GST Registration Cancellation: How to Reply to the Notice and Apply for Revocation

It usually starts with an email from the GST portal, or a supplier telling you your GSTIN shows as "Suspended" or "Cancelled". For many small traders, IT-service startups and freelancers in Hyderabad, the real cause is dull: a few months of returns were never filed, the bookkeeper left, or the founder assumed nil activity meant nothing to file. The rules do give you a way back, but the clock runs from the date the order is served, not from the day you first noticed it.

The short answer. If you get a show-cause notice (Form GST REG-17), you have seven working days to reply in Form GST REG-18, or, where the ground is non-filing, to file the pending returns and pay the dues instead. If the registration is already cancelled by the tax officer on his own motion, you can apply for revocation in Form GST REG-21 within 90 days of service of the cancellation order, and the officer can extend that by up to 180 more days for sufficient cause. For cancellation caused by non-filing, the returns, tax, interest, penalty and late fee must be cleared before the application can be filed.

What the law says and where it applies

This applies to registrations cancelled by the proper officer "on his own motion" (a suo motu cancellation). It does not cover a registration you yourself applied to cancel. The key provisions are these.

Provision What it does
Section 29(2), CGST Act, 2017 Lets the proper officer cancel a registration from a date he decides, including a retrospective date, on listed grounds, after giving the person a hearing
Section 29(2)(b) and (c) Non-filing grounds: a composition taxpayer who has not filed a return for a financial year beyond three months from its due date, and any other registered person who has not filed returns for the continuous period prescribed by the rules (confirm exact wording on the official Act)
Rule 21, CGST Rules, 2017 Prescribes the periods: six continuous months for monthly filers, and two continuous tax periods for quarterly filers (clauses (h) and (i), from 1 October 2022)
Rule 21A Allows the officer to suspend the registration while proceedings are pending
Rule 22 The procedure: notice in REG-17, reply in REG-18, order in REG-19 or drop-order in REG-20
Section 30 and Rule 23 Revocation of cancellation: application in REG-21, order in REG-22, rejection after notice in REG-23 and reply in REG-24
Section 107 First appeal if revocation is refused or the time to apply has run out

Two points matter before anything else. First, cancellation does not wipe out what you owe: under Section 29(3), liability for tax and dues for the period before cancellation continues, and Section 29(5) requires reversal of input tax credit (ITC) on stock and capital goods. Second, the same rules apply across India. We did not find a Telangana-specific rule or notification that changes these timelines; your notice may come from a Central or a State tax officer depending on who administers you, and revocation under the State law is deemed revocation under the CGST Act (Section 30(3)) (confirm Telangana GST Act reference).

Stage 1: the show-cause notice (REG-17)

A REG-17 notice says why the officer thinks your registration is liable to be cancelled. You get seven working days from service to respond. Treat it as the cheapest moment to fix the problem, because nothing has been cancelled yet.

  • Check the ground. Non-filing (Rule 21(h) or (i)), no business at the declared place (Rule 21(a)), invoices without supply (Rule 21(b)) and others are all handled the same way procedurally but need very different answers.
  • If the ground is non-filing: the proviso to Rule 22 lets you skip a long reply. File all pending returns and pay the tax, interest and late fee in full; the officer is then to drop the proceedings by an order in Form GST REG-20.
  • If the ground is something else: reply in Form GST REG-18 with documents, for example a rent agreement or utility bill for the business address. Keep a copy of the portal acknowledgement.
  • Watch for suspension. Under Rule 21A the officer may suspend the registration while the case is pending. During suspension you cannot make taxable supplies or issue tax invoices, and you are not required to file returns for that period.

If you do not reply, or the reply is not accepted, the officer, who has 30 days from the reply under Rule 22(3), passes an order in Form GST REG-19, fixing the effective date and directing payment of arrears.

Stage 2: the cancellation order (REG-19) and the revocation window

Once the REG-19 order is served, the registration is cancelled from the date the officer states. That date may be retrospective. Revocation is the route back, under Section 30 and Rule 23.

Point Position (CGST Rules, as amended from 1 October 2023)
Who can apply A person whose registration was cancelled by the proper officer on his own motion
Form and mode Form GST REG-21, on the common portal, directly or through a notified Facilitation Centre; subject to Rule 10B (Aadhaar authentication) (confirm applicability to your case)
Time limit 90 days from service of the cancellation order (earlier law: 30 days, extendable by 30 + 30)
Extension Commissioner, or an authorised officer not below Additional or Joint Commissioner rank, may extend by up to 180 more days on sufficient cause, with reasons recorded in writing
Officer's decision Revocation order in Form GST REG-22 within 30 days of the application, or rejection in Form GST REG-05 with written reasons
Before rejection Notice in Form GST REG-23; you reply in Form GST REG-24 within seven working days; the officer then decides within 30 days. Section 30(2) bars rejection without a hearing

The extension is not automatic. It depends on showing sufficient cause, such as illness, a bookkeeper's default or a founder abroad, and on the officer being satisfied. The portal functionality for requesting extensions has changed over time, so check the current screen on the GST portal (confirm).

The non-filing rule: clear the returns first

Where cancellation was for failure to file returns, Rule 23(1) says no revocation application can be filed unless those returns are furnished and the tax due under them is paid with interest, penalty and late fee. This is the step that stalls most applications, so build a list of every return period from the first default and compute dues before you open the REG-21 screen.

A second set of returns follows revocation. All returns due from the date of the cancellation order to the date of the revocation order must be furnished within 30 days of the revocation order. Where the cancellation was retrospective, the returns from the effective date of cancellation run on the same 30-day clock. Under Rule 21(ga), inserted from July 2024, breaching these provisos is itself a ground for cancellation (confirm effective date and wording), so do not treat revocation as the finish line.

A worked example (illustrative only)

Assume a Kondapur-based IT-service startup, a monthly filer under the regular scheme, stops filing GSTR-3B after the January 2026 return. Assume it has no output tax in those months and a REG-19 order effective from the date of the order is served on 1 September 2026. These dates and facts are assumptions, not a typical case.

Step What happens Illustrative date
1 REG-19 order served 1 Sep 2026
2 Founder files every missing GSTR-3B (Feb 2026 onwards) and pays any late fee, interest or tax shown Before applying; target well before the deadline
3 Standard 90-day window ends about 30 Nov 2026
4 If sufficient cause exists, an extension request may take the outer limit up to 180 days beyond that up to about 29 May 2027
5 REG-21 filed; officer has 30 days to pass REG-22 or issue REG-23
6 After REG-22, returns for the gap between cancellation and revocation filed within 30 days

The day-count convention (whether the day of service counts) should be confirmed against the order and the portal. Late fee amounts depend on the return type and the notifications in force for the period, so check the current late-fee screen on the portal rather than relying on a rule of thumb.

If the window has closed

A lapsed deadline does not always end the matter, but options narrow and become discretionary. You can appeal the cancellation order under Section 107 within three months of communication, with a further month condonable by the appellate authority, or appeal an order rejecting revocation in the same way. Some High Courts have heard writ petitions where the portal blocked a late application, but those depend on their own facts and are not a plan. If none of this works, a fresh registration may be the practical route; it brings a new GSTIN and does not erase old dues. See our notes on first appeals and fresh GST registration in Hyderabad.

Common mistakes that cost founders their GSTIN

  1. Ignoring the email. Notices land on the registered email and the portal dashboard. If the mailbox belongs to a former bookkeeper, the seven working days are gone before you know.
  2. Replying with an explanation when the officer wants returns. For a non-filing ground, a long letter does not substitute for filing the returns and paying the dues.
  3. Filing REG-21 first and the returns later. For non-filing cases Rule 23(1) requires the returns, tax, interest, penalty and late fee to be cleared before the application.
  4. Forgetting the post-revocation returns. Returns for the gap between cancellation and revocation must follow within 30 days of the revocation order.
  5. Assuming nil activity means nothing to file. A nil GSTR-3B is still a return. This is common among freelancers and IT-service startups with no domestic sales.
  6. Counting from the wrong date. The 90 days run from service of the cancellation order, not from the date you noticed it.
  7. Leaving a dead address on the certificate. Many cancellations rest on the declared place of business. Update the address through an amendment before a notice makes it a problem.

Hyderabad context

In Hitech City, Kondapur and Gachibowli, many small IT-service teams work from co-working desks or founders' homes, and some start-ups move premises within a year. If the GST certificate still shows a previous address, a physical verification or an undelivered notice can start the process. Founders who invoice overseas clients under a Letter of Undertaking often assume there is little to file, so nil returns slip. Small traders in older commercial areas such as Himayat Nagar tend to face the opposite problem: a slow season, a busy owner and a change of accountant. These are typical situations, not statistics, and we do not claim an office in any of these areas. For export-of-services returns and LUT, see our guide on export of services under GST. Why work with ComplianceKart

ComplianceKart is a boutique practice that brings chartered accountants, company secretaries and advocates under one roof, positioned as your Virtual CA, CS, CFO and Advocate. A GST cancellation rarely stays a pure GST problem: there is the return clean-up (accounts and tax), the reply or revocation drafting (legal), and sometimes a related company filing or an appeal. Think of a multi-speciality hospital: the specialists coordinate on one care plan so you do not carry reports between buildings. In the same way, one team can look at your returns, draft the REG-18 or REG-21 submission, and plan an appeal if that becomes necessary. We cannot promise an outcome; the decision rests with the tax officer or the appellate authority, and we will tell you plainly where your position is weak. See about ComplianceKart.

Frequently asked questions

Is a suspended GSTIN the same as a cancelled one?

No. Suspension under Rule 21A is a temporary status while cancellation proceedings run. You cannot make taxable supplies or issue tax invoices during it. If proceedings end without cancellation, the suspension is deemed revoked from the original suspension date.

How long do I have to apply for revocation?

90 days from service of the cancellation order, extendable by up to 180 more days on sufficient cause, with reasons recorded in writing. This is the position under Rule 23(1) from 1 October 2023. Older articles quoting 30 days describe the earlier rule.

Do I have to file all pending returns before applying?

If the cancellation was for non-filing, yes: the returns must be furnished and the tax, interest, penalty and late fee paid before the application can be filed. Returns for the period after cancellation follow within 30 days of the revocation order.

What if my revocation application is rejected?

The officer must first issue a REG-23 notice and hear you (reply in REG-24 within seven working days). If still rejected, an appeal under Section 107 lies within three months of the order, with one more month condonable.

Can I simply take a new GST registration instead?

Possibly, but it creates a new GSTIN and does not remove old liabilities under Section 29(3). Customers and e-commerce platforms linked to the old number will also need updating. Compare the two routes before choosing.

Does cancellation end my liability for old returns and tax?

No. Under Section 29(3), cancellation does not affect liability for tax and dues for periods before the cancellation date, whether determined before or after it.

In short

GST registration cancellation is easiest to fix at the notice stage, harder after the order, and discretionary once the revocation window has passed. Read the notice date and the order date carefully, clear every pending return, and keep proof of each filing. If you are in Hyderabad and a REG-17 or REG-19 has just arrived, a quick review of the dates and the dues is the right first move.
