Trademark Registration for Startups in Hyderabad: Process, Documents, Timeline and Costs
A practical guide for Hyderabad founders to register a trademark in India: search, class selection, filing, examination, opposition and renewal.

A D2C brand founder in Madhapur has spent months building a name, a logo and a following, only to receive a legal notice from another company with a similar mark. A trademark search and filing at the start could have avoided that.
Short answer: a trademark is registered under the Trade Marks Act, 1999 by filing an application (Form TM-A) with the Trade Marks Registry, which examines it, publishes it in the Trade Marks Journal and, if there is no successful opposition, registers it for ten years, renewable. Registration is not instant, and you can use the TM symbol once you apply, but the registered symbol only after registration.

Why startups should register early
- Registration gives the exclusive right to use the mark for the registered goods or services and the right to sue for infringement.
- Unregistered use gives only common law passing-off remedies, which depend on proving reputation.
- Investors and marketplaces often ask for trademark filings during due diligence.
Step-by-step process

- Public search. Search the Registry’s database for identical and similar marks in the same and related classes, and also check domain names and social handles.
- Select classes. Goods and services are grouped into 45 classes under the Nice classification. Fees are per class.
- File Form TM-A online. Individuals, startups and small enterprises pay a lower official fee than other applicants, subject to the current fee schedule (confirm).
- Examination. The Registry examines the mark for absolute and relative grounds of refusal, and may raise objections that you must answer within the prescribed time.
- Publication and opposition. After acceptance the mark is advertised in the Journal, and a third party can oppose within the period prescribed (three months, extendable by one month on request; confirm).
- Registration. A certificate is issued, valid for 10 years from the date of application and renewable for 10-year periods.
Timeline
The overall timeline varies widely with Registry workload, objections and any opposition. Cases without objections can proceed within months, while contested matters take longer. No one can promise a date, so treat any quoted period as indicative.
Documents needed

| For | Document |
|---|---|
| Company or LLP | Certificate of incorporation, and authorised signatory details |
| Logo mark | Clear image file in the prescribed format |
| Claim of prior use | Invoices or first sale evidence, if claiming use from an earlier date |
| Startup concession | Startup recognition certificate, where the lower fee is claimed |
If you hold DPIIT recognition, see our guide to DPIIT startup recognition for concessions on IP fees.
Common mistakes
- Choosing a purely descriptive or generic name that cannot be registered.
- Filing in only one class when the business spans several.
- Using the registered symbol before registration.
- Letting the registration lapse by missing the renewal.

Filing is done online through the IP India portal, so a founder in Kondapur, Hitech City or Kokapet can apply without visiting a Registry office. Check overlap with brands in your sector and search for phonetic similarities, not only exact spellings.
Why work with ComplianceKart
ComplianceKart is a boutique practice bringing Chartered Accountants, Company Secretaries and advocates under one roof. Think of a multi-speciality hospital: you walk in with one concern, and the physician, the radiologist and the surgeon coordinate on your case instead of you running between three clinics. Brand protection works the same way, because it touches company law, tax, banking and contracts at once, and a single coordinated team keeps those pieces consistent.
We do not guarantee approvals or timelines, since those depend on the regulator and on your documents. What we can do is prepare the filings carefully, tell you what is likely to be queried and keep you informed at each step.

You can use TM after applying. The registered symbol can be used only after registration.
Can I file a trademark in my own name?
Yes, but for a company brand it is usually better to file in the company’s name.

Ten years from the application date, renewable for further ten-year periods.
What happens if someone opposes?
Both parties file evidence and may be heard. The outcome depends on the merits.
