Unsigned GST Notice? Telangana High Court’s 30 September Ruling on 500+ Petitions – What Taxpayers Must Do Next
Telangana High Court upheld portal-issued unsigned GST notices in 500+ petitions without deciding merits. Appeal under s.107 – Hyderabad guide.
An order that arrives from the GST portal with no visible signature has been a common writ ground in Telangana. On 30 September 2026 the Telangana High Court closed that door for more than 500 petitions at once.
The short answer: Reports indicate that a Full Bench of the Telangana High Court held that GST show cause notices (SCNs) and demand orders generated through the authenticated GST portal cannot be quashed merely because the downloaded copy shows no visible signature. The Court dealt only with that validity question and, as reported, did not examine the merits of any demand. Taxpayers remain free to pursue the statutory appeal before the First Appellate Authority under section 107 of the CGST/TGST Act. The clock for that appeal is the real danger now.
What did the Telangana High Court decide on unsigned GST notices?
Based on press reports of 30 September – 3 October 2026 (the judgment copy is to be verified before any filing):
| Point | Reported position |
|---|---|
| Date | 30 September 2026 |
| Bench | Full Bench: Chief Justice Aparesh Kumar Singh, Justice N. Tukaramji, Justice G.M. Mohiuddin. (Some descriptions call it a “division bench”; reports say three judges sat – confirm from the order.) |
| Volume | 500+ writ petitions; reported stake about ₹1,500 crore of State GST |
| Question | Are SCNs/orders invalid or liable to be quashed because the signature is not visible on the portal copy? |
| Holding | No. Documents issued through the digitally authenticated GST system were held valid; the signature objection alone does not justify quashing |
| Merits | Not decided. The ruling is confined to the signature/validity objection |
| Relief | Petitions dismissed; assessees may pursue statutory appeals. One report mentions a short window (about two weeks) to pay or appeal – confirm |
The department’s case was that every officer logs in with a digital signature key, and that a missing signature on a downloaded copy can be a display or software issue. Reports also record a live demonstration of the portal to the Court and a GSTN clarification that notices are generated only after digital-signature authentication.
Did the High Court decide the merits of these GST cases?
No. This is the point every taxpayer should be clear on. The Court examined one question: whether the order or notice is vitiated for want of a visible signature. It did not rule on whether the tax, interest or penalty is correct, whether the ITC denial, turnover mismatch or limitation argument is right, or whether the SCN was properly framed. Those grounds were not adjudicated in the batch and stay open before the appellate forum.
Losing the writ on the signature point is therefore not a finding against you on the demand. It only means the High Court will not strike down the order on that ground.
What does this mean for the unsigned-order argument?
The earlier division-bench rulings in Telangana had treated an unsigned notice or order as unable to withstand scrutiny, and had permitted fresh notices. Reports say the Full Bench ruling overrides that line for portal-generated documents. Two cautions:
- It is not a blanket validation. Reports limit the holding to documents issued through the authorised, digitally authenticated system. A paper or e-mailed document with no signature and no portal authentication stands on different footing, and the argument may still be open. (Matter is litigative; read the judgment before relying on this.)
- The issue may travel further. A challenge before the Supreme Court cannot be ruled out. (Position not certain / requires verification.)
What should a Hyderabad taxpayer do now? (7-step action list)
- Obtain the certified/authenticated copy of the judgment and your own order, with the date of communication on the portal.
- Check whether the order is in the “Additional Notices and Orders” tab as well as the “Notices and Orders” tab, and note the date it was first uploaded.
- Compute the appeal deadline under section 107: three months from communication of the order, with condonation of up to one further month. (Confirm; condonation beyond one month is not available to the First Appellate Authority.)
- Prepare the pre-deposit: the admitted amount in full plus 10% of the disputed tax (cap per statute) – confirm the current figure under section 107(6) and the applicable state notification before payment.
- File Form GST APL-01 on the portal with grounds on merits, limitation under section 73/74 time limits, natural justice and quantification. Retain the signature objection as an alternative ground, but do not make it the lead ground.
- If the time for appeal appears to have run out while the writ was pending, take legal advice immediately; whether the period spent in writ proceedings can be excluded is a litigative question. (Position not certain / requires verification.)
- Ask the department in writing for a stay of recovery on the pre-deposit being made.
CA in Kondapur & Gachibowli: how should IT-corridor businesses respond?
Services exporters in Kondapur and Gachibowli, trading companies in Hitech City and Nanakramguda, and SEZ units often receive orders on the portal that nobody tracks. If your demand order is among those affected, the writ route is now unlikely to deliver relief on the signature ground alone. Disputes with real substance (ITC mismatches, export refund denials, wrong place-of-supply, ex parte orders) should be taken to the appellate forum with a properly reasoned memorandum.
Risk assessment
| Issue | Primary position | Alternative | Risk |
|---|---|---|---|
| Signature-only writ for portal orders in Telangana | Not sustainable after the Full Bench ruling | Distinguish non-portal/unauthenticated documents | High |
| Appeal on merits under section 107 | Maintainable; file within time | Writ only for jurisdictional or natural-justice defects | Moderate |
| Time-barred appeal after writ delay | Seek condonation within the statutory outer limit | Constitutional remedy – litigative | High |
| Recovery during appeal | Pre-deposit and stay | Bank-attachment challenge | Moderate |
Why work with a multi-disciplinary practice?
Think of a multi-speciality hospital: a case like this needs a diagnostician, a surgeon and a specialist in the same building. ComplianceKart is a boutique practice with Chartered Accountants, Company Secretaries and advocates under one roof. The CA reconciles the numbers, the advocate drafts the appeal and the grounds, and the CS handles the entity-level filings, so deadlines are not lost in hand-offs. FAQs
Does this judgment say my GST demand is correct?
No. As reported, the Court decided only that the notice or order is not invalid for want of a visible signature. It did not decide the merits of any demand.
Can I still challenge an unsigned GST order in Telangana?
You can raise it in your statutory appeal, but reports indicate the Full Bench has upheld portal-generated documents, so it should not be your only ground. Orders that were not issued through the authenticated portal may be treated differently.
Where do I appeal?
Before the First Appellate Authority under section 107 of the CGST/TGST Act, through Form GST APL-01 on the GST portal. A second appeal lies to the GST Appellate Tribunal (GSTAT) under section 112.
What is the time limit and pre-deposit for the first appeal?
Three months from communication of the order, with a further one month condonable, and a pre-deposit of the admitted tax plus 10% of the disputed tax (confirm the cap and current rules).
I filed a writ and the time has passed. What now?
File the appeal with a condonation application without delay and take advice; the position on excluding writ time is litigative and uncertain.
